Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the website, services, and rental offerings provided by StepUpSmile LLC. By using our website or booking our services, you agree to be bound by these Terms.

 

1. Services

StepUpSmile Photobooths provides professional photobooth rental services for weddings, corporate events, parties, and special celebrations.

Bookings may be made through our website at www.StepUpSmile.com or by contacting us directly at [email protected].

All bookings are subject to availability, confirmation, and acceptance of these Terms.

 

2. Bookings & Payments

a) Deposit & Confirmation:

A non-refundable deposit is required to secure your date. Your event date is not confirmed until the deposit is received.

 

b) Final Payment:

The remaining balance is due no later than 14 days before the event date unless otherwise stated in writing.

 

c) Returned Checks:

A $100 fee will apply for any returned check.

 

d) Taxes:

Applicable taxes will be added at the time of signing.

 

e) Payment Methods:

StepUpSmile LLC accepts payment via credit/debit card, ACH, or approved digital platforms.

 

3. Rental Agreement

a) Rental Period:

The rental period begins and ends at the times confirmed in your booking. Additional hours may be added at $250.00 per hour, subject to availability.

 

b) Equipment Use:

The photobooth equipment may only be used for its intended purpose. The Client is responsible for any damage or misuse by guests. If unsafe behavior endangers equipment or staff, StepUpSmile reserves the right to stop service without refund.

 

c) Attendant Supervision:

All rentals include a trained booth attendant. The attendant's professional judgment on continuing or suspending operations due to environmental or behavioral conditions is final.

 

4. Venue Access & Requirements

a) The Client is responsible for ensuring the venue permits photobooth operation and has the necessary space, access, and power supply.

 

b) For outdoor events, the Client must provide adequate cover and ground protection.

 

c) Setup typically begins 1–2 hours before the scheduled service time unless otherwise agreed.

 

d) Proof of Insurance:

If the venue requires a Certificate of Insurance or other proof of liability coverage, the Client must request this at the time of signing the agreement. Requests made after signing are not guaranteed to be processed in time for the event.

 

5. Payment, Cancellation & Rescheduling

a) Client Cancellations:

The deposit is non-refundable. Any additional rental payments are non-refundable and may be refunded only at the sole discretion of StepUpSmile LLC. Clients are encouraged to reschedule to apply payments (including deposit and rental fees) toward a future event within one (1) year of the original date.

 

b) Rescheduling:

Clients may reschedule their event once at no additional cost, provided the request is made at least 15 days before the original event date. The new date must be within one (1) year and is subject to availability. Additional reschedule requests may incur a fee.

 

c) Company Cancellations:

If StepUpSmile LLC cancels the event due to its own fault or operational issues, a full refund will be issued. If the cancellation results from circumstances beyond the Company’s control (e.g., venue conflicts, safety concerns), the Client may reschedule within one (1) year at no charge.

 

d) Weather Policy (Outdoor Events):

All payments for outdoor events are non-refundable. Clients are encouraged to reschedule in advance if weather is a concern and may reschedule within one (1) year of the original booking date, subject to availability.

 

If the booth is already delivered and set up, and the event is subsequently stopped due to weather, the Client may reschedule and apply a portion of the unused rental time toward a future booking. Credit amount will be determined at the sole discretion of StepUpSmile LLC based on services already rendered.

 

6. Communications & Marketing Opt-In

By providing a phone number or email, you agree to receive transactional and marketing communications via SMS or email.

 

Opt-In Disclosure:

- You agree to receive recurring automated promotional and personalized messages.

- Messaging frequency varies. Standard message and data rates may apply.

- Consent is not a condition for purchase.

 

Opt-Out Instructions:

- SMS: Reply “STOP” to unsubscribe or “HELP” for assistance.

- Email: Click “unsubscribe” in any message or contact [email protected].

 

7. Photo Usage & Intellectual Property

a) Photo Rights:

Clients retain rights to their event photos. By using our services, the Client grants StepUpSmile LLC a non-exclusive, royalty-free license to use select images for marketing purposes unless the Client opts out in writing before the event.

 

b) Company Materials:

All designs, templates, logos, software, and branding are property of StepUpSmile LLC and may not be copied or distributed without written consent.

 

8. Liability & Indemnity

a) Client Responsibility:

The Client assumes responsibility for guest conduct and any resulting damage to equipment.

 

b) Limitation of Liability:

StepUpSmile LLC is not liable for service delays or interruptions caused by factors beyond its control.

 

c) Service Failure:

If a fully operational booth cannot be provided, the Client’s sole remedy is a refund of amounts paid. No additional damages may be claimed.

 

d) Indemnification:

The Client agrees to indemnify StepUpSmile LLC against claims or losses arising from their use of the service.

 

9. Governing Law

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles.

 

10. Severability

If any section of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

 

11. Modifications

StepUpSmile LLC reserves the right to update these Terms at any time without prior notice. The latest version will always be available on our website.
